These Shipping Terms govern all shipping, handling, storage, and related services provided by ShippingXPS. By utilizing our services, you agree to be legally bound by these terms, in addition to our general Terms of Use, which are incorporated herein by reference.
Receiving and Processing Shipments
ShippingXPS will receive shipments on behalf of the customer at its designated storage facility in Delaware and notify the customer upon receipt. Upon arrival, we will provide an itemized breakdown of applicable shipping fees, duties, taxes, and any additional handling charges before dispatch. We do not accept shipments delivered on a Cash on Delivery (COD) basis. The customer is solely responsible for ensuring that all payments are made before the shipment is released. ShippingXPS does not assume liability for incorrect shipment details, including recipient information, addresses or package contents, provided by the customer.
Loss Or Damage of Shipments
ShippingXPS shall not be liable for any loss, theft or damage to packages while in transit from the merchant to our facilities. If a package arrives in visibly damaged condition, we reserve the right to refuse acceptance and return it to the sender and the customer will be notified accordingly. We are not responsible for losses or damages caused by force majeure events, including but not limited to natural disasters, war, government regulations or carrier delays.
Package Inspection and Compliance
ShippingXPS reserves the right to inspect any package received at its facilities to verify compliance with applicable laws, ensure accuracy of declared contents and confirm adherence to carrier restrictions. While we may inspect packages, we are not obligated to do so and assume no liability for undetected damage or discrepancies. Regulatory authorities, including customs agencies, may conduct their own inspections at any time, which may result in delays or additional charges payable by the customer.
Mail and Document Policy
ShippingXPS does not provide mail forwarding services and only accepts shipments containing tangible goods. Any non-package mail, including letters, documents, or promotional materials, will be discarded without notice. Customers are prohibited from using a ShippingXPS address for any purpose other than receiving shipments. Misuse of the address may result in account suspension or termination.
Unidentified Or Unclaimed Packages
If a package is received without sufficient identifying information, we will make reasonable efforts to determine its intended recipient. If the recipient cannot be identified within thirty (2) days, we reserve the right to dispose of or liquidate the package in accordance with applicable law. Customers experiencing shipment delays due to misidentification must contact ShippingXPS customer support with relevant tracking details for resolution.
Shipping and Delivery Terms
Once payment is confirmed, we will arrange international shipment to eligible destinations listed on our website. ShippingXPS reserves the right to consolidate, split or repackage shipments to ensure compliance with international shipping regulations and cost optimization. We shall not be held liable for delays caused by customs processing, regulatory inspections, carrier restrictions or other external factors beyond our control.
Customs Duties and Taxes
Shipments may be subject to customs duties, import taxes and regulatory fees imposed by the destination country. ShippingXPS may pre-calculate and collect estimated customs duties and taxes for select countries with electronic data integration. However, for all other destinations, the customer is responsible for settling any additional duties or taxes with the local customs authority. Customers must provide accurate and truthful declarations of package contents and values. Any misrepresentation or under-declaration may result in fines, delays or seizure by customs authorities. ShippingXPS shall not be liable for penalties arising from inaccuracies in customer-provided declarations.
Shipping Cost Estimates and Final Charges
Shipping cost estimates provided by ShippingXPS are for reference only and may be subject to adjustments based on actual package weight, dimensions, carrier fees and regulatory changes. Customers are responsible for paying the final shipping charges, even if they differ from the initial estimates. Additional handling fees may apply for oversized, hazardous or fragile items, as determined by carrier regulations. Volumetric (dimensional) weight pricing applies to bulky or lightweight packages in accordance with carrier guidelines.
Refused Or Undeliverable Shipments
If a customer refuses to accept a shipment upon arrival due to unpaid customs duties, incorrect shipping details or due to any other reason, the package may be returned to ShippingXPS at the customer’s expense. In the event that a return incurs additional fees, such charges shall be deducted from the customer’s account or charged to the original payment method.
Limitation of Liability
ShippingXPS shall not be liable for any indirect, incidental, consequential or punitive damages arising from the use of its shipping services, including but not limited to lost profits, operational disruptions or reputational harm. Our liability for any loss or damage to a shipment while in our custody shall be limited to the lesser of the actual value of the package contents or the maximum liability amount specified under applicable carrier terms.
Modifications To Terms
ShippingXPS reserves the right to modify, amend or update these terms at any time without prior notice. Continued use of ShippingXPS services following such modifications constitutes acceptance of the revised terms.
Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from or relating to these terms shall be resolved exclusively through arbitration or litigation in the state or federal courts located in California or Delaware, as determined by ShippingXPS. By using ShippingXPS services, you consent to the jurisdiction of these courts and waive any objections based on venue or inconvenient forum.
